The UK has been experiencing radical change in the national security legal landscape, with new national security legislation being passed on an almost yearly basis since 9\/11. This legislation has brought with it new national security powers attached to safeguards to shield against their abuse. Such safeguards include specialist tribunals and the introduction of secret proceedings. This reform has been justified on the grounds that it will enable robust independent review of UK national security powers and ensure ECHR rights are adequately protected. Blending theoretical, doctrinal, comparative, and historical analysis, this book examines the UK’s updated legal system, and the way ECHR rights are protected in UK national security law in practice. The book shows that the current system does not sufficiently safeguard human rights, and relevant UK national security law regimes have become what David Dyzenhaus describes as ‘legal grey holes’. These are legal spaces in which constraints on the executive exist but are not so robust as to meaningfully hold it to account. Furthermore, in providing the appearance of sturdy limitations, such constraints obscure the substance of the powers they surround. In doing so, the presence of legal grey holes has helped to normalise and legitimise ever-expanding national security powers in the UK.
